Terms of Service

Article 1 (Purpose)

These terms and conditions are intended to define the rights, obligations, and responsibilities of the cyber mall and users when using the internet-related services (hereinafter referred to as 'services') provided by Salescore Co., Ltd. (hereinafter referred to as 'Mall'), an e-commerce business operator, through THE HANA (hereinafter referred to as 'Mall').
※ These terms and conditions shall also apply to electronic commerce using PC communication, wireless, etc., unless it is contrary to their nature.

Article 2 (Definitions)

① 'Mall' refers to a virtual business place set up by Salescore Co., Ltd. to trade goods or services (hereinafter referred to as 'goods, etc.') with users using information and communication facilities such as computers, and also means the business operator operating the cyber mall.
② 'User' refers to members and non-members who access the 'Mall' and receive the services provided by the 'Mall' in accordance with these terms and conditions.
③ 'Member' refers to a person who has registered as a member of the 'Mall' and can continuously use the services provided by the 'Mall'.
④ 'Non-member' refers to a person who uses the services provided by the 'Mall' without registering as a member.

Article 3 (Specification, Explanation, and Amendment of Terms and Conditions)

① The 'Mall' shall post the contents of these terms and conditions, the name of the company and representative, the address of the business office (including the address for handling consumer complaints), telephone number, fax number, e-mail address, business registration number, mail-order business report number, and personal information protection officer, etc., on the initial service screen (front page) of THE HANA Mall so that users can easily find them. However, the contents of the terms and conditions may be made available to users through a linked screen.
② Before the user agrees to the terms and conditions, the 'Mall' must provide a separate linked screen or pop-up screen to ensure that the user can understand important contents such as withdrawal of subscription, delivery responsibility, and refund conditions specified in the terms and conditions, and obtain the user's confirmation.
③ The 'Mall' may amend these terms and conditions to the extent that it does not violate relevant laws such as the Act on Consumer Protection in Electronic Commerce, the Act on the Regulation of Terms and Conditions, the Framework Act on Electronic Documents and Transactions, the Electronic Financial Transactions Act, the Electronic Signature Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Door-to-Door Sales Act, and the Framework Act on Consumers, etc.
④ If the 'Mall' amends the terms and conditions, it shall specify the application date and reason for the amendment and notify the current terms and conditions together with the amended terms and conditions on the initial screen of the Mall from 7 days before the application date to the day before the application date. However, if the amendment is unfavorable to users, a grace period of at least 30 days shall be provided. In this case, the 'Mall' shall clearly compare the contents before and after the amendment so that users can easily understand them.
⑤ If the 'Mall' amends the terms and conditions, the amended terms and conditions shall apply only to contracts concluded after the application date, and the provisions of the terms and conditions before the amendment shall apply to contracts already concluded. However, if a user who has already entered into a contract wishes to be subject to the amended terms and conditions, and sends their intention to the 'Mall' within the notice period of the amended terms and conditions under paragraph 3 and obtains the consent of the 'Mall', the amended terms and conditions shall apply.
⑥ Matters not specified in these terms and conditions and the interpretation of these terms and conditions shall be governed by the Act on Consumer Protection in Electronic Commerce, the Act on the Regulation of Terms and Conditions, the Consumer Protection Guidelines in Electronic Commerce, etc. established by the Fair Trade Commission, and related laws or commercial practices.

Article 4 (Provision and Change of Services)

① The 'Mall' performs the following tasks:
1. Providing information on goods or services and concluding purchase contracts
2. Delivery of goods or services for which a purchase contract has been concluded
3. Other tasks determined by the 'Mall'
② In the event of out-of-stock goods or changes in technical specifications, the 'Mall' may change the contents of goods or services to be provided under future contracts. In this case, the changed contents of the goods or services and the date of provision shall be specified and immediately announced at the place where the current contents of the goods or services are posted.
③ If the 'Mall' changes the contents of the service contracted with the user due to out-of-stock goods or changes in technical specifications, the reason shall be immediately notified to the user at an address that can be contacted.
④ In the case of the preceding paragraph, the 'Mall' shall compensate the user for any damages caused thereby. However, this shall not apply if the 'Mall' proves that there was no intention or negligence.

Article 5 (Suspension of Service)

① The 'Mall' may temporarily suspend the provision of services in the event of maintenance, replacement, breakdown of computers or information and communication facilities, or interruption of communication.
② The 'Mall' shall compensate users or third parties for damages caused by the temporary suspension of the provision of services for the reasons stated in paragraph 1. However, this shall not apply if the 'Mall' proves that there was no intention or negligence.
③ If the service cannot be provided due to conversion of business items, abandonment of business, or integration between companies, the 'Mall' shall notify users in the manner specified in Article 8 and compensate consumers according to the conditions originally presented by the 'Mall'. However, if the 'Mall' does not notify the compensation standards, etc., users' mileage or points, etc., shall be paid to users in kind or cash equivalent to the currency value used in the 'Mall'.

Article 6 (Membership Registration)

① Users apply for membership by filling out member information according to the registration form set by the 'Mall' and expressing their intention to agree to these terms and conditions.
② The 'Mall' registers as members those users who apply for membership as described in paragraph 1, unless they fall under any of the following:
1. If the applicant has previously lost membership under Article 7(3) of these terms and conditions, except in cases where 3 years have elapsed since the loss of membership under Article 7(3) and the 'Mall' has approved re-registration as a member.
2. If there is any false information, omission, or error in the registration details
3. If it is determined that registering as a member would cause significant technical difficulties for the 'Mall'
③ The membership contract is established when the acceptance of the 'Mall' reaches the member.
④ If there are any changes to the information registered at the time of membership registration, the member must notify the 'Mall' of the changes within a reasonable period by modifying member information or other methods.

Article 7 (Withdrawal and Loss of Membership, etc.)

① Members may request withdrawal from the 'Mall' at any time, and the 'Mall' shall immediately process the withdrawal.
② If a member falls under any of the following, the 'Mall' may restrict or suspend membership:
1. If false information was registered at the time of application
2. If the member fails to pay the price of goods purchased using the 'Mall' or other debts related to the use of the 'Mall' by the due date
3. If the member interferes with the use of the 'Mall' by others or steals information, or otherwise threatens the order of electronic commerce
4. If the member uses the 'Mall' to engage in acts prohibited by laws or these terms and conditions or contrary to public order and morals
③ If the same act is repeated twice or more after the 'Mall' restricts or suspends membership, or if the reason is not corrected within 30 days, the 'Mall' may revoke membership.
④ If the 'Mall' revokes membership, the membership registration is canceled. In this case, the member is notified and given an opportunity to explain for at least 30 days before the membership registration is canceled.

Article 8 (Notification to Members)

① When the 'Mall' notifies a member, it may do so to the e-mail address designated in advance by the member and the 'Mall'.
② In the case of notification to an unspecified number of members, the 'Mall' may substitute individual notification by posting on the 'Mall' bulletin board for at least one week. However, for matters that have a significant impact on the member's own transaction, individual notification shall be made.

Article 9 (Purchase Application)

① Users apply for purchase on the 'Mall' by the following or similar methods, and the 'Mall' must provide the following information in an easy-to-understand manner when users apply for purchase:
1. Search and selection of goods, etc.
2. Entering the recipient's name, address, phone number, e-mail address (or mobile phone number), etc.
3. Confirmation of the contents of the terms and conditions, services with limited right of withdrawal, and costs such as delivery and installation fees
4. Indication of agreement to these terms and conditions and confirmation or rejection of the matters in 3 above (e.g., mouse click)
5. Application for purchase of goods, etc. and confirmation thereof or consent to the 'Mall's confirmation
6. Selection of payment method
② If the 'Mall' needs to provide or entrust the buyer's personal information to a third party, it must obtain the buyer's consent at the time of actual purchase application, and comprehensive consent is not obtained in advance at the time of membership registration. In this case, the 'Mall' must specify to the buyer the items of personal information provided, the recipient, the purpose of use of the recipient, and the period of retention and use. However, if otherwise provided by relevant laws such as the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., the relevant laws shall apply.

Article 10 (Conclusion of Contract)

① The 'Mall' may not accept a purchase application as in Article 9 if it falls under any of the following. However, in the case of a contract with a minor, the 'Mall' must notify that the contract may be canceled by the minor or their legal representative if consent is not obtained from the legal representative:
1. If there is any false information, omission, or error in the application
2. If a minor purchases goods or services prohibited by the Youth Protection Act, such as tobacco or alcohol
3. If it is determined that accepting the purchase application would cause significant technical difficulties for the 'Mall'
② The contract is deemed to be concluded when the acceptance of the 'Mall' reaches the user in the form of a receipt confirmation notice under Article 12(1).
③ The expression of intention to accept by the 'Mall' must include information on the user's purchase application, availability for sale, correction or cancellation of the purchase application, etc.

Article 11 (Payment Method)

The payment methods for goods or services purchased from the 'Mall' may be made by any of the following available methods. However, the 'Mall' may not collect any nominal fees in addition to the price of goods, etc., for the user's payment method:
1. Various account transfers such as phone banking, internet banking, and mail banking
2. Various card payments such as prepaid cards, debit cards, and credit cards
3. Online deposit without a bankbook
4. Payment by electronic money
5. Payment upon receipt
6. Payment by points provided by the 'Mall' such as mileage
7. Payment by gift certificates contracted with or recognized by the 'Mall'
8. Other electronic payment methods, etc.

Article 12 (Receipt Confirmation Notice, Change and Cancellation of Purchase Application)

① When there is a purchase application from a user, the 'Mall' sends a receipt confirmation notice to the user.
② Upon receiving the receipt confirmation notice, the user may request change or cancellation of the purchase application if there is any discrepancy in the expression of intention, etc., and the 'Mall' shall process the request without delay if the request is made before delivery. However, if payment has already been made, the provisions regarding withdrawal of subscription, etc. in Article 15 shall apply.

Article 13 (Supply of Goods, etc.)

① Unless otherwise agreed with the user regarding the timing of supply of goods, etc., the 'Mall' shall take necessary measures such as order production and packaging so that goods, etc. can be delivered within 7 days from the date the user makes a subscription. However, if the 'Mall' has already received all or part of the price of goods, etc., necessary measures shall be taken within 3 business days from the date of receipt of all or part of the price. In this case, the 'Mall' shall take appropriate measures to allow the user to check the supply procedure and progress of goods, etc.
② The 'Mall' shall specify the delivery method, the party responsible for delivery costs for each method, and the delivery period for each method for goods purchased by the user. If the 'Mall' exceeds the agreed delivery period, it shall compensate the user for damages caused thereby. However, this shall not apply if the 'Mall' proves that there was no intention or negligence.

Article 14 (Refund)

If the 'Mall' cannot deliver or provide goods, etc. that the user has applied to purchase due to out-of-stock, etc., it shall immediately notify the user of the reason and, if payment has been received in advance, refund the payment or take necessary measures for refund within 3 business days from the date of receipt of the payment.

Article 15 (Withdrawal of Subscription, etc.)

① A user who has entered into a contract for the purchase of goods, etc. with the 'Mall' may withdraw the subscription within 7 days from the date of receiving a written contract under Article 13(2) of the Act on Consumer Protection in Electronic Commerce (if the supply of goods, etc. is later than the receipt of the written contract, the date of receipt of goods, etc. or the date the supply of goods, etc. begins). However, if otherwise provided by the Act on Consumer Protection in Electronic Commerce regarding withdrawal of subscription, the relevant provisions shall apply.
② Users may not return or exchange goods, etc. in any of the following cases after receiving them:
1. If goods, etc. are lost or damaged due to reasons attributable to the user (however, withdrawal of subscription is possible if the packaging is damaged to check the contents of goods, etc.)
2. If the value of goods, etc. has significantly decreased due to the user's use or partial consumption
3. If the value of goods, etc. has significantly decreased to the extent that resale is difficult due to the passage of time
4. If the packaging of goods, etc. that can be reproduced with the same performance is damaged
③ In the case of subparagraphs 2 to 4 of paragraph 2, if the 'Mall' does not clearly state in a place where consumers can easily find it that withdrawal of subscription, etc. is restricted or does not provide trial products, the user's withdrawal of subscription, etc. is not restricted.
④ Notwithstanding paragraphs 1 and 2, if the contents of goods, etc. are different from the contents indicated or advertised or are performed differently from the contract, the user may withdraw the subscription, etc. within 3 months from the date of receiving the goods, etc., or within 30 days from the date the user knew or could have known the fact.

Article 16 (Effect of Withdrawal of Subscription, etc.)

① If the 'Mall' receives goods, etc. returned from the user, it shall refund the price of goods, etc. already paid within 3 business days. In this case, if the 'Mall' delays the refund of goods, etc. to the user, it shall pay delay interest calculated by multiplying the delay period by the delay interest rate prescribed by the Enforcement Decree of the Act on Consumer Protection in Electronic Commerce.
② When refunding the above price, if the user has paid the price of goods, etc. by credit card or electronic money, the 'Mall' shall immediately request the business operator who provided the payment method to suspend or cancel the claim for the price of goods, etc.
③ In the case of withdrawal of subscription, etc., the user shall bear the cost required to return the goods, etc. The 'Mall' shall not claim a penalty or damages from the user for withdrawal of subscription, etc. However, if the contents of goods, etc. are different from the contents indicated or advertised or are performed differently from the contract, the 'Mall' shall bear the cost required to return the goods, etc.
④ If the user bore the shipping cost when receiving goods, etc., the 'Mall' shall clearly indicate who bears the cost when withdrawing the subscription so that the user can easily understand.

Article 17 (Protection of Personal Information)

① The 'Mall' collects the minimum personal information necessary to provide the service when collecting users' personal information.
② The 'Mall' does not collect information necessary for the fulfillment of purchase contracts in advance at the time of membership registration. However, if it is necessary to verify the user's identity before the purchase contract in order to fulfill obligations under relevant laws, the minimum specific personal information may be collected.
③ When the 'Mall' collects and uses users' personal information, it notifies the user of the purpose and obtains consent.
④ The 'Mall' may not use the collected personal information for purposes other than the intended purpose, and if a new purpose of use arises or it is provided to a third party, it notifies the user at the stage of use or provision and obtains consent. However, exceptions are made if otherwise provided by relevant laws.
⑤ If the 'Mall' is required to obtain the user's consent under paragraphs 2 and 3, it must specify or notify in advance the identity of the personal information protection officer (affiliation, name, and phone number, and other contact information), the purpose of collection and use of information, matters related to the provision of information to third parties (recipient, purpose of provision, and content of information to be provided), etc., as prescribed in Article 22(2) of the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., and the user may withdraw this consent at any time.
⑥ Users may request to view and correct errors in their personal information held by the 'Mall' at any time, and the 'Mall' has an obligation to take necessary measures without delay. If a user requests correction of an error, the 'Mall' does not use the personal information until the error is corrected.
⑦ The 'Mall' shall limit the number of persons handling users' personal information to the minimum necessary for the protection of personal information, and is responsible for all damages caused to users due to loss, theft, leakage, provision to third parties without consent, or alteration of users' personal information, including credit cards and bank accounts.
⑧ The 'Mall' or a third party who has received personal information from it shall destroy the personal information without delay when the purpose of collection or provision is achieved.
⑨ The 'Mall' does not pre-select the consent box for the collection, use, and provision of personal information. It also specifically states the services that are restricted if the user refuses to consent to the collection, use, and provision of personal information, and does not restrict or refuse the provision of services such as membership registration on the grounds of refusal to consent to the collection, use, and provision of non-essential personal information.

Article 18 (Obligations of the 'Mall')

① The 'Mall' shall not engage in acts prohibited by laws or these terms and conditions or contrary to public order and morals, and shall do its best to provide goods and services continuously and stably as stipulated in these terms and conditions.
② The 'Mall' shall have a security system to protect users' personal information (including credit information) so that users can safely use internet services.
③ If the 'Mall' causes damage to users by engaging in unfair labeling or advertising acts prescribed in Article 3 of the Act on Fair Labeling and Advertising regarding goods or services, it shall be liable for compensation.
④ The 'Mall' does not send commercial e-mails for profit that users do not want.

Article 19 (Obligations Regarding Member's ID and Password)

① Except as provided in Article 17, the responsibility for managing ID and password rests with the member.
② Members must not allow third parties to use their ID and password.
③ If a member becomes aware that their ID and password have been stolen or are being used by a third party, they must immediately notify the 'Mall' and follow the instructions of the 'Mall' if any.

Article 20 (Obligations of Users)

Users must not engage in the following acts:
1. Registering false information when applying or changing
2. Stealing other people's information
3. Changing information posted on the 'Mall'
4. Transmitting or posting information (such as computer programs) other than the information set by the 'Mall'
5. Infringing on the intellectual property rights of the 'Mall' or other third parties
6. Damaging the honor of the 'Mall' or other third parties or interfering with their business
7. Disclosing or posting obscene or violent messages, images, voices, or other information contrary to public order and morals on the 'Mall'

Article 21 (Relationship between Linked 'Mall' and Linked 'Mall')

① If the upper 'Mall' and the lower 'Mall' are connected by a hyperlink (e.g., the target of the hyperlink includes text, pictures, and moving images), the former is called the linking 'Mall' (website) and the latter is called the linked 'Mall' (website).
② If the linking 'Mall' clearly states on the initial screen of the linking 'Mall' or at the time of connection that it does not guarantee transactions with users by goods, etc. independently provided by the linked 'Mall', it is not responsible for such transactions.

Article 22 (Attribution and Restriction of Copyright)

① Copyright and other intellectual property rights for works created by the 'Mall' belong to the 'Mall'.
② Users must not use information obtained by using the 'Mall' for commercial purposes or allow third parties to use it by reproduction, transmission, publication, distribution, broadcasting, or other methods without the prior consent of the 'Mall' if the information belongs to the 'Mall'.
③ If the 'Mall' uses the copyright belonging to the user according to the agreement, it must notify the user.

Article 23 (Dispute Resolution)

① The 'Mall' installs and operates a damage compensation handling organization to reflect legitimate opinions or complaints raised by users and compensate for the damage.
② The 'Mall' gives priority to handling complaints and opinions submitted by users. However, if prompt processing is difficult, the reason and processing schedule will be immediately notified to the user.
③ If a user's damage relief application is filed in connection with an electronic commerce dispute between the 'Mall' and the user, it may be subject to mediation by a dispute mediation agency commissioned by the Fair Trade Commission or the mayor/governor.

Article 24 (Jurisdiction and Governing Law)

① Lawsuits regarding electronic commerce disputes between the 'Mall' and users shall be subject to the address of the user at the time of filing, and if there is no address, the place of residence shall be under the exclusive jurisdiction of the district court having jurisdiction over the place of residence. However, if the address or residence of the user at the time of filing is unclear or in the case of a foreign resident, the lawsuit shall be filed with the competent court under the Civil Procedure Act.
② Korean law applies to electronic commerce lawsuits filed between the 'Mall' and users.

Supplementary Provisions (Effective Date)

These terms and conditions shall take effect from March 1, 2025.
